Record Companies Seek to Block Release of Lil Wayne’s
90s Rock Mashup Album with a Cease and Desist Letter
(November 26, 2010, New York, NY) - Cash Money Records and Universal Group have sent a cease and desist letter to DJ Alexei in an attempt to stop the release of Lil Wayne’s remix album that features mashups of the artist’s material with classic 90s recordings from Nirvana, Pearl Jam, Stone Temple Pilots, Radiohead, Smashing Pumpkins and other influential rock acts. The album, Weezy’s 90s Ball, Vol. 1 is currently scheduled for November 4, 2010 to coincide with Lil Wayne’s release from jail.
The album’s producer DJ Alexei has expressed regret at the labels’ decision, but remained optimistic that Lil Wayne’s fans would get to hear the album. “While I’m flattered that label executives see Weezy’s 90s Ball as a threat to the ‘I Am Not a Human Being’ profits, they are being shortsighted - the fans will buy the official release even if they had downloaded Weezy’s 90s Ball because these are two completely different bodies of work,” said Alexei. “Lil Wayne released the free ‘No Ceilings’ mixtape not long before ‘Rebirth’ and that doesn’t appear to have hurt sales.” Alexei added that it will ultimately be up to the fans to make sure that everyone could get a copy of Weezy’s 90s Ball “just as they made sure that Danger Mouse’s ‘Grey Album’ didn’t die a quiet death after the cease and desist letter.”
The full text of the cease and desist letter is below.
Dear DJ Alexei:
I am the attorney for Cash Money Records, Inc. (“Cash Money”). It has come to the attention of Cash Money that you have produced and manufactured and will distribute, starting November 4, 2010, an unauthorized audio CD entitled “Alexei Presents Lil Wayne & Alexei, Weezy’s 90s Ball, Vol. 1, Remixes, Mashups by DJ Alexei” (the “CD”) embodying performances of Cash Money’s exclusive artist professionally known as “Lil Wayne” (“Artist”).
Please be advised that Cash Money is the exclusive owner and distributor of master recordings created by Artist during the term of Artist’s recording agreement with Cash Money (the “Agreement”) and therefore only Cash Money has the right to exploit Artist’s recordings and performances. Moreover Universal Motown Republic Group (“Universal”) is Cash Money’s exclusive worldwide distributor and the only company with the right to distribute Artist’s records and performances.
Cash Money hereby demands that you cease and desist any and all production, manufacture, distribution and exploitation Artist’s recordings and performances (including the CD). Neither Cash Money nor the Artist have granted you the right to exploit any recordings or performances created by Artist and consequently your exploitation of Artist’s recordings and performances constitutes an infringement of Cash Money’s exclusive rights to Artist and Universal’s exclusive right to distribute Artist’s recordings and performances.
It is our hope to resolve this matter amicably without resort to formal legal process. However your exploitation of Artist’s recordings may give rise to a cause of action in law and/or equity. Therefore, please confirm that you will not distribute the CD or any other of Artist’s recording or performances and you will remove any mention of the CD from all of your websites, including without limitation, your Facebook and myspage pages.
This email should not be construed as a waiver, limitation, or relinquishment of any of Cash Money’s or Universal’s rights or remedies, whether legal or equitable, all of which are hereby expressly reserved.
